APEX Privacy Policy

This Privacy Policy describes how Apex Health Network, Inc., doing business as APEX or Apex Health ("APEX," "we," "us," "our"), collects, uses, and shares information when you use our mobile application, website, and related services (the "Services").

1. Information We Collect

A. Information You Provide

  • Account information (email address, username, profile details you choose to provide)
  • Communications with us (support requests, feedback)

B. Information From Connected Devices and Services

If you connect third-party services (such as Apple Health, Google Health Connect, Garmin, WHOOP, Fitbit, Oura, or Polar), we may collect data you authorize, which may include:

  • Activity and workout summaries
  • Cardiovascular activity metrics
  • Resting heart rate (RHR)
  • Heart rate variability (HRV)
  • Sleep duration and sleep consistency
  • Other wellness or recovery-related metrics where available

C. Automatically Collected Information

  • Device and app information (device type, operating system, app version)
  • Usage and diagnostic data (e.g., feature usage, crash logs)

2. How We Use Information

We use information to:

  • Provide, operate, and maintain the Services
  • Generate insights, summaries, and recommendations
  • Enable social features, teams, clubs, events, and prize pools
  • Process payments and administer prize pool events
  • Maintain security, prevent fraud, and enforce our Terms
  • Improve and develop the Services

3. Privacy, Visibility, and Social Sharing

A. Default Privacy

Users may use APEX with their data remaining private to:

  • The user
  • APEX
  • Our storage and infrastructure providers acting as service providers (who are not permitted to access or use data except to provide services to APEX)

B. Teams, Clubs, Events, and Followers

If you join a team, club, or event, or accept followers, certain high-level metrics may become visible to others depending on visibility settings. These may include:

  • HRV and RHR
  • Sleep hours and sleep consistency
  • Cardiovascular activity summaries
  • Other aggregated or high-level performance indicators

Visibility may be limited to members of a team/club/event or may be broader depending on configuration. By joining a team, club, or event, or by accepting followers, you consent to this sharing.

C. Public and Private Profiles

  • Public profiles may display selected high-level metrics to other users.
  • Private profiles may still share high-level metrics with accepted followers and with members of teams, clubs, or events you join.

4. We Do Not Sell Your Data

APEX does not sell personal data or health/activity data to third parties. We use data solely for operating, improving, and supporting the Services and related business purposes.

5. Service Providers

We may share information with trusted service providers (e.g., hosting, databases, analytics, payments) that process data only on our behalf and under contractual obligations.

6. Data Retention and Deletion

We take reasonable steps to honor deletion requests.

If you delete your account:

  • We will delete or de-identify personal account data where reasonably possible.
  • You may be removed from teams, clubs, or events going forward.
  • Historical records (such as past event results, leaderboards, or aggregated statistics) may remain and may not be fully removable.

7. Security

We use reasonable technical and organizational measures to protect data, but no system can be guaranteed to be completely secure.

8. Children

The Services are not intended for children under 13 years of age (or older where required by law). We do not knowingly collect data from children.

APEX Terms of Service

Effective Date: December 18, 2025

These Terms of Service ("Terms") govern your use of the Services provided by Apex Health Network, Inc. (doing business as APEX or Apex Health). By using the Services, you agree to these Terms.

1. Eligibility and Account

You must be at least 13 years old (or older if required by law). You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2. Privacy and Social Features

Your use of the Services is subject to our Privacy Policy. You acknowledge that participation in teams, clubs, events, prize pools, or accepting followers may result in sharing of high-level metrics as described in the Privacy Policy.

3. Not Medical Advice; Assumption of Risk

APEX provides wellness and fitness information for informational purposes only and does not provide medical advice.

You should always consult a qualified medical professional before making changes to sleep, exercise, diet, or mental health practices.

By using the Services, you acknowledge and agree:

  • You assume all risks associated with physical activity and health-related decisions.
  • APEX is not responsible for injuries, illnesses, health conditions, or damages occurring before, during, or after your use of the Services, including those arising from reliance on data, insights, or recommendations.

4. Third-Party Services

The Services may integrate with third-party platforms. APEX is not responsible for third-party services, their data accuracy, availability, or interruptions, and your use of them is subject to their terms.

5. Acceptable Use

You agree not to:

  • Violate laws or others' rights
  • Access or attempt to access accounts or data without authorization
  • Manipulate events, prize pools, or leaderboards fraudulently
  • Interfere with or reverse engineer the Services
  • Introduce malicious software or abuse the Services

6. User Content

You retain ownership of content you submit. You grant APEX a limited license to host, process, and display content as necessary to operate the Services.

7. Payments, Prize Pools, and Refunds

APEX may offer paid features, events, or prize pools.

  • Eligibility rules may apply and will be disclosed for each event.
  • Identity or activity verification may be required to prevent fraud.
  • You are responsible for any taxes associated with prizes.

Refunds: Except where required by law, all payments are final and non-refundable, and APEX reserves the right to deny refund requests at its discretion.

8. Termination

You may stop using the Services at any time. APEX may suspend or terminate access to the Services to enforce these Terms or protect users, the platform, or legal compliance.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEX WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEX'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID APEX IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless APEX from claims arising from your use of the Services, your content, or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

13. Changes

We may update these Terms. Continued use of the Services after changes means you accept the updated Terms.
